Terms & Conditions

These Terms and Conditions govern the use of the KuuSh website, the purchase of KuuSh products and interactions with services provided by KuuSh, whether online, by telephone, in writing or through other authorised channels.

By accessing our website, placing an order or engaging with our services, you agree to the applicable Terms and Conditions set out below.

KuuSh reserves the right to update these Terms and Conditions from time to time. The terms applicable to an order are those in effect when the order is placed, unless otherwise agreed.

01

Products and Information

KuuSh takes reasonable care to ensure that product descriptions, photographs, pricing and other information are accurate and current.

Product information is provided for general guidance. Individual experiences and results may vary.

Customers are responsible for reviewing product information, including ingredients and suitability for their individual requirements.

Nothing in these Terms and Conditions excludes any rights or guarantees that cannot lawfully be excluded.

02

Orders and Acceptance

All orders are subject to acceptance by KuuSh.

KuuSh reserves the right to decline or cancel an order where reasonably necessary, including circumstances involving suspected fraud, misuse of our services, pricing errors, product unavailability or conduct that interferes with our business operations.

Where payment has been received for an order that KuuSh does not accept, the payment will be refunded in accordance with applicable law.

Customers must provide accurate and complete information when placing an order.

03

Payments and Pricing

All prices are displayed in Australian dollars unless otherwise stated.

Payment must be completed through an authorised payment method before an order is processed, unless alternative arrangements have been agreed in writing.

KuuSh may amend product pricing, availability and promotional offers without prior notice. Changes will not retrospectively alter an accepted order unless agreed with the customer or permitted by law.

Promotional offers are valid for the period specified and are subject to availability. Unless expressly stated, promotions cannot be transferred to other brands or combined with unrelated offers.

04

Product Preparation and Availability

KuuSh products are developed and produced with careful attention to formulation, quality and presentation.

Order preparation and dispatch may vary according to product availability, order requirements and operational circumstances.

Where a material delay or availability issue arises, KuuSh will communicate with the customer and provide the options required by applicable law.

KuuSh reserves the right to discontinue products or modify its product range.

05

Packaging and Presentation

KuuSh may update packaging, containers, closures, labels and presentation from time to time.

Product images are intended to represent the products offered. Minor variations in packaging or presentation may occur.

Any material change to a product, including its quantity or essential characteristics, will be handled in accordance with applicable consumer law.

06

Delivery and Shipping

Customers must ensure that their delivery address and contact details are accurate when placing an order.

Orders will be dispatched to the delivery address confirmed at checkout.

Customers should notify KuuSh immediately if they identify an error in their delivery details. Address changes cannot be guaranteed once an order has entered dispatch processing.

Available shipping methods and applicable charges will be displayed during checkout.

Tracking information will be provided where tracking is included in the selected delivery service.

Customers are encouraged to monitor tracking updates and contact KuuSh promptly if a delivery issue arises.

KuuSh is not responsible for delays or losses caused solely by incorrect information supplied by a customer, subject to applicable law and the circumstances of the delivery.

07

Product Concerns and Fault Assessment

KuuSh maintains quality standards and takes concerns regarding product integrity seriously.

Customers who believe a product has arrived damaged, defective or otherwise unsuitable are requested to contact KuuSh within three (3) days of delivery wherever reasonably possible.

This assists us in promptly investigating concerns relating to product condition, packaging, storage and transportation.

Customers should provide their order details, a description of the concern and photographs where appropriate.

All reported product faults are subject to assessment by KuuSh before a determination is made regarding the appropriate resolution.

Depending on the circumstances, customers may be asked to provide additional information or make the product available for examination or laboratory assessment.

Products should not be returned without first contacting KuuSh for instructions.

Where assessment establishes that a product has been damaged through misuse, inappropriate storage or unauthorised alteration after delivery, KuuSh is not obliged to provide a remedy unless required by law.

Where a product fails to meet applicable consumer guarantees, KuuSh will provide the remedy required by law, including reimbursement of reasonable return costs where applicable.

The request to contact us within three days does not limit any statutory consumer rights.

08

Consumer Guarantees

KuuSh complies with applicable Australian Consumer Law.

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law.

You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage.

You are also entitled to have goods repaired or replaced if they fail to be of acceptable quality and the failure does not amount to a major failure.

KuuSh does not offer voluntary change-of-mind returns or exchanges unless expressly agreed.

Nothing in these Terms and Conditions restricts a customer's rights under applicable consumer protection legislation.

09

Nothing in these Terms prevents any person from making a lawful complaint, expressing an honest opinion, reporting a concern to a regulator or exercising their legal rights.

11

Website Content and Customer Submissions

The content published by KuuSh remains protected by applicable intellectual property laws.

Customers retain ownership of original material they submit to KuuSh.

Where a customer voluntarily provides a review, testimonial, photograph or other material for publication, KuuSh may request permission to reproduce or feature that material in its communications.

Private correspondence and personal information will be handled in accordance with applicable privacy laws and KuuSh's privacy practices.
