These Terms of Use apply to the Services currently offered by KuuSh as well as Services that may be offered in the future.
Payment Terms for anyone contracted to do work is strictly 30 days end of month from when invoices are received. Termination of work, for any reason whatsoever, means the person/Company/business must cease immediately and without access or interference. To do otherwise, may result in legal action. Anyone doing any kind of work for any of our staff or brands will comply with all of the Terms and Conditions contained herein, pertaining to conduct.
YOUR USE OF THE SERVICES CONSTITUTES YOUR ACCEPTANCE OF THIS AGREEMENT AND INDICATES OUR WILLINGNESS TO BE BOUND BY THESE TERMS OF USE.
SERVICES
KuuSh is not responsible for inaccurate information provided through the Services and makes no representations as to the accuracy, reliability, timeliness, or completeness of Content, including without limitation, the description, availability or effectiveness of any product. Services include, but are not limited to phone, website, in person, or any media whatsoever. KuuSh does not assume any liability for any loss that may result from the reliance by any person upon any Content provided through the Services.
ACCESS
KuuSh reserves the right to permit or restrict any user's access to the Services, in its sole and absolute discretion, including the termination of user accounts in the event of a breach of these Terms of Use by the user, and including KuuSh retains the right, in its sole and absolute discretion, to refuse to sell a product or products to a person, a business or a Company.
CONTENT
All content including, but not limited to, what you provide and what KuuSh provides, phone conversations, emails, websites, videos, and any type of transmissions, are owned by KuuSh.
KuuSh shall not be subject to any obligation of confidentiality. By providing information, you hereby grant the Company/KuuSh, a perpetual, worldwide, irrevocable, unrestricted, non-exclusive, royalty-free right and license to use, copy, edit, license, sublicense, adapt, distribute, display, publicly perform, reproduce, transmit, modify, create derivative works from, and edit any such Content for any purpose, commercial, advertising, or otherwise on or in connection with, or relating to any product, and/or products, the Services, or the promotion thereof.
Furthermore, by using our Services, you agree to defend, and hold harmless, KuuSh, its parents, affiliates, and subsidiaries, together with their respective employees, agents, officers, directors, shareholders and licensees, from and against any and all threats, and claims of alleged or actual infringements of any intellectual property rights, proprietary rights, rights of privacy and publicity, moral rights, and rights of attribution raised by any third party against the KuuSh Parties and you agree to reimburse the KuuSh Parties for any loss, damage, defamation of character or costs incurred as a result.
You agree that you will neither post nor submit any User Generated Content in any manner whatsoever, nor will speak anything about KuuSh and its parties which includes but is not limited its staff, owners, founders and any Parties that is unlawful, rude, disrespectful, slanderous, defamatory, derogatory, nor encourage others to do so. Violating this will result in Legal Action and you shall incur all costs, including claims for any and all damages.
POSTAL ADDRESS AND DELIVERY
Make sure the address you have on checkout/payment is CORRECT as your items will be sent to THAT ADDRESS and we are not liable or responsible if you made a mistake or do not inform us of any changes at the time of purchase. If paying with PayPal, we send to your PayPal address, unless advised differently at the TIME of actual payment.
REFUNDS
Refunds are NOT offered under any circumstance, including, but not limited to a change of mind. We reserve the right to replace a product in your order if it is out of stock. This includes but is not limited to any promotions, special offers and the KuuSh Deluxe Box.
IF you deem a product/s to be faulty you must contact us within 72 hours of item/s being delivered, and you may be required to provide evidence including sending the item/s back to us for a Laboratory Analysis. If it is not found to be faulty or if it has been tampered with, KuuSh will not reimburse you for the postage or any other costs assosciated with the return of the product/s and the product/s will NOT be replaced.
Tracking numbers are provided on all orders within Australia. You will be advised of your Tracking Number and it is your responsibility to track it with Australia Post and to liaise with Australia Post if you have any queries regarding it.
ORDER
Your order/s is/are subject to the acceptance by KuuSh and at its sole and absolute discretion, KuuSh retains the right to refuse an order or orders without giving a reason. By using this website and placing an order, by any means, you are agreeing to these Terms and Conditions and at no time are you to decide what the Terms and Conditions are. Any complaints made to PayPal or other that is not removed when requested is violating our Terms and Conditions. This may see you removed from any correspondence from KuuSh and may result in future orders NOT being fulfilled; any payment for a future order that KuuSh does not want to fulfill will simply be reversed/refunded.
Any offer made made by KuuSh is strictly limited to 48 hours only unless stated otherwise. Any offer may end earlier if sold out of that which is being offered.
Any offer by KuuSh can strictly not be transferred or cross over to any other brand/s that it may be associated with.
TIME TO PROCESS
All orders are made fresh to order in the order of which they are received. They ARE NOT mass produced. You must allow at least 28 WORKING DAYS. for your order to be made and during unprecedented times such as now with COVID-19 it is acceptable to allow a longer time period to make orders fresh from scratch. It is your responsibility to order ahead of time. If you do not agree to these Terms and Conditions, please refrain from placing an order. We are very busy with filling orders and upholding our contracts with multiple locations throughout the world and we appreciate your understanding. It is not a matter of pick and pack, rather, we are a bespoke brand producing high-level products.
PRODUCTS AND PACKAGING AND PRICING
Containers, including bottles, sizes, jars and closures and all associated packaging may change from time to time or differ from pictures and photos depicted on the website or any media without prior notice. Any item/s including those on sale may come with a generic label. Pricing may change at anytime without prior notice.
INTELLECTUAL PROPERTY
Our Intellectual Property includes but is not limited to logos, photos, names, drawings, wording, tag lines, products, recipes, Modus Operandi, and creations. You are not to try and emulate what we do, or our formulas, nor put yourself in the same realm of promoting a brand or brands.
You do not have permission to use KuuSh logos, photos or any of our information or IP without the written consent from KuuSh, which will also be subject to Terms and Conditions.
LIABILITIES
You understand that the use of the Services is at your own risk.
You agree to be responsible for any and all claims, including third-party claims, liability, damages and costs, (including, but not limited to legal fees, costs and expenses) against or incurred by the KuuSh Parties that result from, arise out of or are in any way connected to your breach to these Terms and Conditions/Terms of Use, your negligence, wilful misconduct or your infringement, lack of communication or ill feelings.
These Terms and Conditions of Use sets forth the entire understanding and agreement between you and KuuSh.
LEGAL ISSUES
Free Postage and Handling does not apply on Sales.
Any legal issues will be dealt with and governed by the Laws in South Australia
